1) Presentation

Isabelle Roc's website proposes many services: one part allows you to discover her works in an online exhibition and another part is dedicated to the selling of her paintings with the possibility of ordering a piece of art by commision.

Those services (purchases, orders) are submitted to the terms and conditions of sales, which permit to define the obligations and rights between Isabelle Roc and people who want to subscribe to the services of this website.

These terms and conditions apply to all the services (purchases, orders etc) proposed by Isabelle Roc. This means, you as a visitor/buyer must read and accept these conditions.

However, please be aware that the general conditions can change. People, interested in this website should refer to them regularly as they commit the buyer as soon as they are written online.


2) Precisions about the offered services

The pictures of the paintings and drawings published on the website are just representation of the works. The pictures were made so that they could reflect the real colors of the paintings at best, but the colors could be different as the colors of a painting varies with the lightning.

The buyer must accept those tone differences. The pictures are not part of the contract.

Furthermore, the dimensions written on the website are not precise and are just an indication, they could vary in centimeter. The buyer must accept this difference.

It is not possible to exchange a painting with another one, because each work is unique. Isabelle Roc works as a paid artist and doesn't get author's rights.


3) Orders

Every order form is signed by the customer when the "confirm" button is clicked. This serves as the customer's accept and cannot be cancelled. This click has the same value as a written signature. The finalization of the sale will be done after the email confirmation sent by Isabelle Roc in which all the details of the contract will be listed (order, price, shipping details, shipping price etc.).

Isabelle Roc has the right to cancel an order of a customer if there has been suspicion of fraud in regards to a previous order or for any other reasons such as paintings or drawings being sold through other channels. If this will be the case, Isabelle Roc must inform the customer in writing as soon as possible. The same works presented in the webshop could be presented at the same time in national or international exhibitions and could be sold before the work was removed from the website.

Concerning orders by commision, the customer will have the possibility to verify the details of the order and to correct any mistakes or changes by email, until the total satisfaction of the customer. This will end the transaction and the work will be shipped. The works can be sent outside of France on demand.


4) Prices, taxes and payments

- Prices
The prices can be modified on the website at anytime and will be invoiced based on the prices written during the order process. No prices can be modified once the order is finished, unless there is a particular demand from the customer which could modify the order completely.

- Taxes
Being in the BNC, Roc Isabelle does not have to pay the TVA (TVA inapplicable, art 293 B du CGI). The prices of the services are written and invoiced without taxes.
Any other tax or fee, created or modified, increased or decreased, may be reflected in the selling prices of the services proposed by Isabelle Roc.

- Payments
The payment will be made by the buyer before the shipping of the order.
Concerning orders by commision, the customer must pay 50% of the agreed price in advance and the remaining 50% when the work is shipped.

5) Shipping

In the case of a commisioned order, the length of execution will be defined between the customer and Isabelle Roc. The order will be included in Isabelle's schedule. Moreover the time will depend on the techniques used by the artist (oil paint, pastels, crayons, ink etc.), the size of the work and on the materials chosen. The work of the commisioned piece of art will only begin when half of the price is paid. An invoice will be sent when the work is finished.

The shipping can take from 1 to 6 weeks (or more) depending on to where the work will be sent. When a painting available on the site is ordered, the order will be sent by Colissimo (Poste) in 3 working days after payment is received.

If a shipping/tracking number is available it will be sent to the customer via email so the shipment can be tracked.

The shipping form, giving by the transporter, dated and signed by the customer when receiving the shipment will be proof of completed shipping and delivery.

The risks are at the charge of the buyer once the work leaves the workshop. On delivery, the customer will have to check the package, the conformity and the shape of the work before signing the shipping form. Isabelle Roc is not responsible for any damages or theft after the order has left her address, and complaints have to be adressed to the transporter by registered mail with acknowledgment of receipt to the carrier within 3 days of delivery. If any problem is witnessed by the customer when the package is delivered, the customer must deny to receive the package or write his concern on a form (precisely and dated) and sent to the transporter as stated above. A copy of this letter will be sent to Isabelle Roc.

The delivery address could be different from the one mentionned for billing purposes in the invoice. The shipment will be sent to the address written on the order form.


6) Shipping fees:

Shipping fees will be based upon weight and destination of each individual order. When you've placed your order, you'll receive an email with an individually calculated shipping price and means of payment within 5 business days. If you accept the shipping fee, you confirm your order by paying according to the terms. Shipping fees will always cover a shipping option that includes tracking as well as insurance.


7) Responsibility limits

Isabelle Roc is not responsible for any problems affecting the sales process or causing delays when these can be traced back to strikes, natural catastrophes or similar.
Isabelle Roc's responsibility is limited to the price of the order and she cannot be blamed for errors or omissions that might arise due to technical issues despite the care given to managing the website and handling of the payment process etc.


8) Intellectual property

Isabelle Roc's works are protected by national and international copyright and neighboring rights regulations. Isabelle Roc concedes in these conditions to the buyer a right of personal and non-transferable use of the works.

The buyer undertakes under these conditions not to reproduce, modify, alter or republish the works without the express prior permission of Isabelle Roc, which excludes all transactions of transfer, resale, rental, exchange, and placing available to third parties by any means.


9)  Jurisdiction in case of dispute

These Terms and Conditions of Sale are presented and governed by French law. Any dispute concerning the present, in the absence of amicable agreement, will be submitted to the only competent Commercial Court.
